Terms & Conditions of Selling Your Watch to Us

Please note: Use of this Goldsmiths Pre-Owned website to sell your watch is restricted to enquiries from individual watch owners in the United Kingdom and the Channel Islands only who are aged 18 years or older. If you are selling watches commercially or you are VAT registered or you are under 18, you should not use this website.

The Basis of our Contract with you

In order to sell your watch on the Goldsmiths Pre-Owned website, you will be asked to tick the box marked "Tick to Accept terms and conditions" to affirm that you have read, accept and agree to be bound by these terms and conditions when completing your transaction and selling your watch. If you fail to tick this box you will be unable to sell your watch to us on the Goldsmiths Pre-Owned website.

These terms and conditions shall govern the agreement between you and Watches of Switzerland Company Limited trading as Goldsmiths Pre-Owned ("us") to the exclusion of any other terms or conditions.

These terms and conditions supersede all previous terms and conditions and shall replace any terms and conditions previously notified to you.

No variation to these terms and conditions shall be binding on us unless contained in our order or agreed in writing between you and us.

No contract to purchase your watch will be formed when we receive your enquiry or when we confirm receipt of your enquiry or if we ask for further information about your watch or when we provide an initial online valuation of your watch. Our contract with you will only be formed after we have inspected the watch you wish to sell to us and we have provided to you our post-watch inspection valuation, in which we offer to buy the watch for and this price has been accepted by you on these terms and conditions.

Your obligations and promises to us

It is a condition of this contract, and you promise to us that the watch you offer to sell to us

  • is genuine,
  • is solely your property and does not belong to anyone else
  • is not subject to any hire purchase agreement, charge or other third party interest
  • is not a fake, counterfeit, imitation, illegal copy or a non-original
  • does not infringe the intellectual property rights of any third party
  • complies with all legal and/or regulatory requirements and
  • was lawfully purchased by or for you

You promise that you are aged 18 years or older and you are the legal owner of the watch offered for sale to us. [NB identity terms].

You promise that by offering to sell us a watch on the Goldsmiths Pre-Owned website you are a member of the general public and NOT a business, organisation, cooperative or trader (whether sole, market or otherwise). You do not sell watches commercially and are not VAT registered.

You understand that we require 2 different forms of ID when submitting a valuation in store. One must be a passport or driving license. The valuation cannot be submitted successfully without these.

You understand, accept and agree that Goldsmiths Pre-Owned pricing of products (the valuation(s) or offer price(s)) shall not be used by you on or for any other website(s)/mobile application(s) or on any price comparison websites/services.

You are not permitted to use this Website:

  • To create, check, confirm, update, modify or amend your own or another person's databases, records or directories.
  • Using any automated software, process, program, robot, web crawler, spider, data mining, trawling or other 'screen scraping' software, process, program or system.

If you offer your watch for sale to Goldsmiths Pre-Owned via this website, we will require details of your watch including make, model and condition. It is important that you provide all requested information fully and accurately. The initial online valuation we will provide for your watch will be based solely on the information supplied by you. You promise that your description of your watch is accurate and not misleading. An inaccurate, false or misleading description may lead to an inaccurate valuation of the watch and any such valuation will be reviewed and may subsequently be decreased. We appreciate that not all clients are experts in assessing the condition of their watch, therefore, we carry out a thorough inspection of every watch before making a firm offer to buy it. All initial online valuations are therefore provided on a "Subject to Contract and Inspection" basis and are not legally binding. If we consider that the watch is not as described by you in any way that affects its value, the price that we offer for it will differ from the initial online valuation. We will e-mail you an amended valuation and the contract will be formed only if and when you accept that amended valuation on these terms and conditions.

Upon inspection of your watch, if any item is not in accordance with these terms and conditions we may in our sole discretion reject the item and either make it available for your collection at our store where you brought it to us or return it to you. If we find any item(s) that we believe to be stolen, lost, counterfeit, fake, imitation, an illegal copy, a non-original product or an infringement of third party rights, we may remove any branding which we reasonably believe have been applied to your watch without the correct brand owner's authority and/or dispose of the items at our sole discretion. All such items will not be paid for, will not be returned and we may report such incidents to the relevant authorities.You understand, agree and accept that the determination as to the originality of the watch that you wish to sell to us is at our sole discretion. Our decision that the watch is lost, stolen, fake, counterfeit, imitation, illegal or an infringement of third party rights will be taken reasonably but is final and no further discussion on this will be entered into by us.

You agree to compensate us for all losses damages actions, awards and/or claims arising from our possession, grading, inspecting, assessing, reviewing, offering for sale, selling, altering and/or destroying your watch, if it does not accord with these Terms and conditions or it is stolen, lost, counterfeit, fake, imitation, an illegal copy, a non-original product or it infringes third party rights.

If we find upon inspection of the watch(s) that it has been registered/reported lost or stolen or we believe the watch you have sent to us could be fake, counterfeit or otherwise infringe the rights of any third party, we will notify you by email and quarantine the watch whilst we contact the relevant/appropriate authorities. If we have paid you for the watch, we will treat the contract with you as never having been made and all sums paid to you by us shall be repaid to us within 7 days of our email to you to this effect.

Valuation of your Watch & Payment

All prices quoted by Goldsmiths Pre-Owned for the purchase of watches will be in pounds sterling. Two valuations and payment options will be offered to you. The first payment option and valuation (both the initial online valuation and post-watch inspection valuation) will be for a straight cash purchase of your watch from you. The second payment option and valuation (both initial online and post-watch inspection valuation) will be in exchange for value to be added to one of our gift cards to be spent at one of our stores. Generally (but not always), the initial online valuation and post-watch inspection valuation for the purchase of your watch for value added to our gift card will be higher than the initial online valuation and post-watch inspection valuation for a cash purchase. The price of your watch will be our confirmed valuation following our inspection of the watch and this price will be fixed for 28 days after which it will lapse and not be capable of acceptance by you.

N.B. You may NOT alter or update the payment method once we have accepted your choice of payment method.

  1. The first payment option is cash for a straight purchase of your watch and will be sent to you by means of BACS transfer. This transfer will be into the bank account nominated by you in the valuation process if we have received your payment details. It is your responsibility to ensure that your bank account details are entered correctly. You may update these payment details in the "My Account" section of the website and it is your responsibility to do so. It remains your sole responsibility to ensure that the payment details you have provided and are displayed in the "My Account" section of our website are correct, complete and accurate. We will not be liable if you fail to receive a payment or suffer any loss, including but not limited a payment being sent to an incorrect account or recipient, as a result of any failure by you to correctly, completely and accurately provide and/or submit all Payment Details required when using our website.
  2. The second payment option is in exchange for the value of the agreed post-watch inspection valuation being loaded on to one of our gift cards which is valid for the purchase of goods or services supplied by any of the Watches of Switzerland Company Limited companies, namely Watches of Switzerland, Goldsmiths and Mappin & Webb. If you wish to choose to receive the proceeds of your sale as value added to one of our gift cards then you will be asked first to agree to individual terms and conditions of use for our Gift Cards which you can access here. You must agree to the Gift Card terms and conditions in order for you to choose this payment method and before the gift card is issued to you. If you do not agree to the Gift Card terms and conditions then you will be unable to receive the proceeds of your sale in this way. Once you have selected a Gift Card as a Payment Method and we have accepted that choice, you will be unable to change this payment type. The terms of our Gift cards are incorporated into these Terms and conditions.

You understand, agree and accept that some of the payment methods made available to you depend on third parties who we cannot and do not control to process these payments including, but not limited to, payments by bank transfer (BACS). We will not be liable for delay in receipt of payment as a result of the actions or inactions taken by such third parties. Payments may be subject to validation and security checks that we or third parties may require at our/their discretion from time to time. Your statutory rights are not affected.

Whilst we endeavour to always provide accurate valuations, it is possible, as a result of human error or system failure, that an incorrect price may be quoted. This will be corrected at the earliest possible opportunity. Goldsmiths Pre-Owned cannot be held responsible for human error or system failure and are not obliged to pay you the price quoted in the incorrect valuation. If we discover an error in any of our valuations we will inform you as soon as possible and cancel the purchase.

Please note that when we sell any watch purchased from you the sale price we seek will probably be higher than any of the valuations we have provided to you but there are numerous reasons for this including the fact that we may undertake various works to the watch to restore it.

We aim to complete transactions and send payment to the account shown in the Payment Details or issue you with your Gift Card within 5 working days of you accepting the final valuation offer. However, this cannot be guaranteed and the process may take up to 10 working days depending on the level of checks required and the time of year. Please note that we will regularly communicate with you by email regarding the progress and status of each order and you may log onto the "My Account" section of our website to look into the order history for status updates.

Delivery of your Watch to us

Goldsmiths Pre-Owned offers the following ways to send your watch to us and in each case, you will need to ensure that you provide your watch together with the transaction number issued to you when we provide you with our initial online valuation of your watch.

  1. You may take your watch to any branch of Watches of Switzerland , Goldsmiths or Mappin & Webb. You will be given a receipt for the watch and it will be forwarded to Goldsmiths Pre-Owned Head Quarters or
  2. You may send your watch to us by a reputable courier or post service to Pre-Owned Department. Aurum House, 2 Elland Road, Braunstone, Leicester. Leicestershire. LE3 1TT.

In each case it is always prudent to insure your watch for loss or damage until we have completed the transaction with you and in each case you need a unique transaction number which can be downloaded from our website in the "My Account" section. You must ensure that you attach the correct transaction number to each watch you send to us.

It is a condition that all watch(es) have been properly and sufficiently packaged and labelled by you with the correct transaction number.

Your watch will be insured whilst in transit from our store to our Head Quarters but the value of the watch for this insurance purchase will be up to the value we have placed on the watch in our initial online valuation prior to our inspection. No other valuations will be accepted other than that of the Goldsmiths Pre-Owned valuation for these insurance purposes so if you require it to be insured at a higher value in transit you should insure the watch for that higher sum with your own insurers.

Risk

If you take your watch to one of our stores, Goldsmiths Pre-Owned becomes responsible for your watch when a receipt for it is issued in our store. If you send us your watch by any other means, Watches of Switzerland becomes responsible for your watch only when it is received and you are responsible for any loss or damage occurring prior to our receipt of your watch so it is essential that you package it securely and insure it appropriately.

Ownership of your watch

The watch you offer to sell us must be solely your property and not belong to anyone else either wholly or partly. If it is your watch it will remain your property until a confirmed post-watch inspection valuation is agreed between us and payment is made to you or a Gift Card with the agreed value added to it has been issued to you. Title to/ownership of the watch passes to Watches of Switzerland Pre-Owned at the moment payment is issued to you by BACs or our Gift Card is issued to you with the agreed valuation loaded on to it.

Privacy

The Watches of Switzerland Group Limited trading as Goldsmiths Pre-Owned is committed to protecting your privacy. The information you give us will be stored for regulatory reasons and used to enable us to provide an online valuation and post-watch inspection valuation of your watch. This information will be stored for the purpose of making payment to you or issuing you with our Gift Card and in case we need to address any complaint or problem or notify any relevant authorities of any suspicion we have that your watch is lost, stolen or fake. Please ensure that you read our Privacy Policy by clicking here. Our Privacy Policy explains our data processing practices and your options regarding the ways in which your personal data is used. If you have any requests concerning your personal information or any queries with regard to our processing please contact us using the details in our contact us section on the website. The Information contained in our Privacy Policy is incorporated into these terms and conditions.

You may not transfer, charge, assign or in any way dispose of our contract with you or any of your rights or obligations arising under it, without our prior written consent which may be electronically communicated by way of e-mail.

Nothing in these Terms and conditions is intended to or shall operate to create a partnership, agency, employment, joint venture of any kind between you and us.

We shall not be liable for any delay or failure in performing our obligations under these terms and conditions as a result of any reason beyond our reasonable control.

No purported variation of these terms and conditions shall take effect unless made in writing and signed by an authorised representative of Watches of Switzerland Company Limited trading as Goldsmiths Pre-Owned.

None of the terms of any contract with you shall be enforceable by any person who is not a party to it.

For residents of England and Wales

Any contract between us and you, the interpretation of these terms and conditions and all claims arising out of any contract between us and you including non-contractual claims shall be governed by the laws of England and Wales. You and we agree to submit to the exclusive jurisdiction of the courts of England and Wales in relation to all claims arising from any contract between us and you including non-contractual claims.

For residents of Scotland

Any contract between us and you, the interpretation of these terms and conditions and all claims arising out of any contract between us and you including non-contractual claims shall be governed by the laws of Scotland. You and we agree to submit to the exclusive jurisdiction of the courts of Scotland in relation to all claims arising from any contract between us and you including non-contractual claims.

For residents of Northern Ireland

Any contract between us and you, the interpretation of these terms and conditions and all claims arising out of any contract between us and you including non-contractual claims shall be governed by the laws of Northern Ireland. You and we agree to submit to the exclusive jurisdiction of the courts of Northern Ireland in relation to all claims arising from any contract between us and you including non-contractual claims.
